General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all orders placed by consumers or entrepreneurs via the PLAU online shop with

Alexander Lutsyuk
Sole proprietorship
Business designation: Arnika Plau

Dr. Alban Str. 24
19395 Plau am See
Germany.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.

2. Contracting party

The purchase contract is concluded with:

Alexander Lutsyuk
Sole proprietorship
Business designation: Arnika Plau

Dr. Alban Str. 24
19395 Plau am See
Germany

Email: shop@plau.shop
Phone: +4938735 954990 (AI phone assistant)

3. Offer and conclusion of contract

The presentation of products in the online shop does not yet constitute a legally binding offer to conclude a purchase contract.

By submitting an order, the customer makes a binding offer to purchase the goods contained in the shopping cart.

The contract is concluded when we accept the order by means of an order confirmation by email or hand over the goods for delivery to the customer.

Details of the ordering process are presented in the online shop.

4. Prices and payment terms

The prices stated are total prices and include statutory VAT where this is legally payable.

Additional shipping costs are stated in the respective offer or during the ordering process.

The available payment methods are shown to the customer during checkout.

Currently available payment methods include PayPal, PayPal Pay Later and payment in advance (Vorkasse). For payments via PayPal, PayPal’s applicable terms and conditions also apply.

The purchase price is due immediately after conclusion of the contract, unless otherwise stated for the respective payment method.

5. Delivery

Delivery is made to the delivery address provided by the customer during the ordering process.

Available delivery areas, shipping costs and expected delivery times are stated in the online shop or during checkout.

If an ordered product is unavailable for reasons beyond our control, we will inform the customer without undue delay and promptly refund any payments already made for unavailable goods.

6. Personalised products

In addition to standardised products, PLAU also offers individually personalisable products.

For personalised products, the customer may in particular select or submit individual texts, images, design options or other personal specifications.

Made-to-order or print-on-demand production alone does not automatically exclude the right of withdrawal.

Where a product is manufactured specifically for the customer based on the customer’s individual specifications and the statutory requirements of Section 312g(2) no. 1 BGB are met, there is no statutory right of withdrawal for that product.

The customer will be expressly informed of any such exclusion before submitting the order.

The specific design and the information entered by the customer must be checked before completing the order.

The customer’s statutory rights in the event of defects remain unaffected.

7. Retention of title

The goods remain the property of the seller until payment has been made in full.

8. Statutory liability for defects

The statutory provisions on liability for defects apply.

In the event of a defect, the customer is entitled to the statutory rights, in particular the right to subsequent performance and – subject to the statutory requirements – withdrawal from the contract or reduction of the purchase price and, where applicable, damages.

The consumer’s statutory rights are not restricted by these Terms and Conditions.

9. Liability

We are liable without limitation for damage arising from injury to life, body or health and for damage caused by intentional or grossly negligent conduct.

For damage caused by slight negligence, we are liable only in the event of a breach of material contractual obligations. In that case, liability is limited to the foreseeable damage typical of the contract.

Liability under mandatory statutory provisions, in particular under the Product Liability Act, remains unaffected.

10. Right of withdrawal

Consumers generally have a statutory right of withdrawal.

For clearly personalised products, the right of withdrawal may be excluded under the statutory requirements of Section 312g(2) no. 1 BGB. Print-on-demand or made-to-order production alone does not automatically exclude that right.

For an ordinary change-of-mind withdrawal, the customer bears the direct return shipping costs where legally permitted and disclosed before ordering. If goods arrive damaged, defective or incorrect, the customer does not bear the costs of resolving the issue.

Details are set out in our separate cancellation policy.

11. Consumer dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Applicable law

The law of the Federal Republic of Germany applies.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

13. Place of jurisdiction

If the customer is a merchant, a legal entity under public law or a special fund under public law, the seller’s place of business is the place of jurisdiction for all disputes arising from contractual relationships between the seller and the customer.

For consumers, the statutory rules on jurisdiction apply.

14. Contract language

The language available for conclusion of the contract is German.
